sorry to bug abody again but as a matter of interest...
does anyone know what the law says about taping phone conversations?
I know when you phone the bank, insurance etc they warn you at the start that it may be taped for training purposes - but how do you stand with a private call being tape recorded without your knowledge or permission?

All answermachines with the abiliy to tape convos bleep every few seconds so both callers can hear it.

As such taping a call is one thing, but using it in court is another. in order to use it legaly the person must be aware that they are being recoreded.. well thats my understanding

At work the law gets very hazy,, in theory the employer can do all sorts without you knowing and use it against you.

On a similar subject...

We had an incident of parents taping a parent/teacher conference without letting the teacher know. It is in the terms of our contract that we have to have formal talks with parents twice a year, but there is no protection from the taping. Incidentally - the tapes could not be produced in a court of law, but apparently a transcript of it could. :evil:

thank you for that, it's good to know - I'm sure it won't come to court though ::lol::
but I felt it was unfair of the person that did it - and it wasn't my employer, but someone I phoned through the course of work....not that I said anything I shouldn't have, but it's the principle of the thing....
and the 'I've taped this conversation you know and am about to listen back' said with such venom at the end :eek:

Oh, .. put it in that context Felicity just sounds like someone was playing mind games with you, a tactic to win whatever the convo was about, as an ex call centre employee I`ve heard them all.

Make a personl note of when the call was made what it was about just in case and then forget about it.

your defense could alaways be. "you have edited that tape" hence frowing doubt on any transcript ... not that its ever going to go that far. so dont worry

I don't know about your laws. I've used taping with people that I haven't trusted at all if we have had a meeting - and I have said that I won't be in that meeting if I can't tape it for my own security. I have used taping also when I have had an interview face to face because of part of my studies - and I have asked written permission to do it. My father has used taping when he have had an interview with someone to his book, but he has asked a permission from a person. Permission that has been said is enough over here, sometimes it's polite to have written permission. And I wish that Police can have a permission to listen and tape whenever and whatever they want if they are suspecting someone.
