Here's an interesting question a Moped by definition is 49cc restricted to 50 KPH (31 MPH).
So now it gets interesting ,my brother is looking at buying a new Kingroad XT50-18 Sport. It's advertised as learner legal at 16yrs but it also says they can do about 38MPH which would ,I think ,make it a Motorcycle and you'd have to be 17yrs to be legal to ride it. The other point is that my brother can ride a Moped without 'L' plates and without the need of a CBT with his car license but if the bike is a Motorcycle he needs a CBT and 'L' Plates.
I know also that if the restrictions are removed on the bike then it would be classed as a Motorcycle and be capable of 50+ MPH.
I think paying the extra for the CBT is a safer option and he can run derestricted rather than run the risk of finding out the hard way that he's not licensed or insured and I think 9 points (3 for license and I think 6 for insurance).
But I'd still be interested in what you think on the subject. I'm going to ask at the local bike center next time I get oil for mine. A Google search found someone asking the question on a Police forum ,he had the definition quoted back and the bit about modifications changing the class.
