The Football Association has charged Manchester United striker Ruud van Nistelrooy with serious foul play following his tackle on Ashley Cole.
The Dutch star went over the ball as he caught the England left back with a crude looking challenge during United's 2-0 win over Arsenal.
Referee Mike Riley missed the incident which has meant The FA can take action against van Nistelrooy, and that is what they have done.
The FA have charged the Red Devils ace with breaching rule E3 and he has until Tuesday October 26 to admit or deny the offence.
The case is to be heard by The FA's disciplinary commission on October 28.
The FA have also confirmed that Arsenal manager Arsene Wenger has been asked to explain his post-match comments, where he criticised both Riley and van Nistelrooy.
