DJ in gay football row to sue News Group




A DJ who has been linked to the News of the World's allegations about gay footballers is joining England star Ashley Cole in taking libel action against the newspaper group.

The urban music DJ has instructed his solicitors, David Price, to sue News Group Newspapers, owner of the News of the World and the Sun.

Cole has already filed writs against News Group Newspapers, according to trade magazine Press Gazette.

The Arsenal defender is said to be suing for harassment, libel and breach of privacy, even though he was not named in the News of the World story, published on February 12, which alleged that two unnamed Premiership footballers and a music DJ engaged in a "homosexual orgy".

Although he was not identified in the News of the World story, Cole has been named on websites including PinkNews.co.uk which has published a photograph sourced from the Choice FM website, which it alleges is the undoctored version of one used in the News of the World.

In the News of the World picture, which does not involve a sex act, the faces of two men were obscured and several small changes appear to have been made digitally.

Benjamin Cohen, the founder and editor of PinkNews.co.uk, said: "We took an editorial decision to publish the photographs together with an animated comparison between the photographs printed in the News of the World and the Choice FM website."

"All we sought to prove was that the photographs were of the same individuals and not to make any inferences as to the sexuality of the men pictured."

Mr Cohen was at pains to point out that Pinknews.co.uk does not dispute a statement issued by Cole.

"We have no reason to doubt the testimony of Mr Cole and his assertions that he has not had relationships with the man pictured or indeed any man," Mr Cohen said.

"I am still perplexed as to why the News of the World decided to run the story at all. There is nothing illegal about being gay and individuals have the right to privacy in regards to their sexuality and other sensitive areas of their lives."

The News of the World and Cole's lawyers did not comment.

England star sues for libel after gay sex story starts online rumour mill

Landmark case to test the water of defamation laws
The Arsenal and England left-back, Ashley Cole, is planning a landmark court action over claims that two anonymous top flight footballers were involved in a "gay sex orgy", despite not being named in connection with the tabloid story.

If it goes to court, the case could have implications for the tabloid press and their Faustian pact with the celebrity world.

Cole has decided to sue for harassment, breach of privacy and libel after rumours over his sexuality spread like wildfire on the internet, fuelled by a series of articles in the News of the World and the Sun that did not name him but contained broad hints at his identity.

Legal experts view the case as an important step in taking the temperature of libel and privacy law in cases where the aggrieved parties are not named but the public is able to build up a "jigsaw" identification via tabloid hints that spark gossip via email, blogs and chatrooms.

They said the privacy part of the claim was "unique" because it relied on an untested concept known as "false privacy" - even though Cole says he is not gay, he will argue his privacy has been invaded.

"It's not a clear-cut case," said Mark Stephens, media solicitor at Finers, Stephens, Innocent. "It's difficult for both sides. But ultimately it's going to be embarrassing for the newspaper unless they were publishing on strong grounds."

The original story, heavily trailed by TV advertisements the previous night, appeared in the News of the World on February 12. Headlined "Gay as you go", it claimed that "two bisexual stars made some very dirty phone calls - using a mobile as a gay sex toy". It also claimed that a reporter had seen a recording of the alleged incident. However, the news paper did not claim to have a copy of the recording. It returned to the allegations the next week.

The tongue-in-cheek treatment continued in the News International stablemate the Sun, which later alluded to the story in the caption on a paparazzi snap of the footballer out on the town with his pop star fiancee, Cheryl Tweedy, prompting a letter to newspaper editors by Cole's solicitors. At no stage did either newspaper name the footballer or explicitly use his picture, making the libel claim unusual. But legal sources believed he could have a strong case none the less.

"There is a risk when newspapers indulge in this sort of nudge nudge, wink wink insinuation that they will end up in court," said David Engel, a partner at the law firm Addleshaw Goddard.

In cyberspace several sites published the picture used by the News of the World to accompany its second story and suggested it was a crudely doctored version of a snap of Cole and a dance music DJ taken from the website of a radio station, Choice FM. The gay website Pink News featured a juxtaposition of the picture used in the tabloid and the alleged original, suggesting they were the same shot doctored by the paper.

Its editor, Benjamin Cohen, said he didn't believe Cole was gay but wanted to expose the methods of the tabloid and alert the media to the speed with which internet rumours spread. "We're not in the business of outing people. It's more to show that what the newspaper is doing is wrong. A lot of the media and lawyers don't understand how the internet works," said Mr Cohen, a former teenage dotcom whizz who claimed the page had 200,000 visitors, making it one of the first on view when users searched via Google.

Cole is likely to argue that the suggestion he is gay or bisexual is tantamount to accusing him of hypocrisy and thus damages his reputation.

The pop star Robbie Williams won £200,000 in damages in December from the People and Star magazine over articles claiming he had covered up gay relationships. It was judged to be defamatory because it suggested he had deceived the public by presenting a false image.

Cole, 25, is no stranger to the front pages and has had a fractious relationship with the tabloids. Investigations by the News of the World last summer exposed his clandestine meetings with Chelsea's manager, Jose Mourinho, in a London hotel over a proposed transfer. Cole was fined £100,000 by the Premier League for his part in the tapping-up row.

Neither Cole's lawyers nor News International would comment.

Masterstepz, a DJ for radio station Choice FM, is joining England footballer Ashley Cole in legal action against the Sun and the News of the World.

The DJ, real name Ian Thompson, is suing for defamation over stories claiming two unnamed footballers were involved in a"gay sex orgy" with a "well known DJ".

"Although Masterstepz was not named, the manner of publication has led to his being identified as the DJ alleged to have been involved," said solicitor David Price. "The articles used a photograph of Masterstepz with Cole ... crudely pixellated in an attempt to conceal their identities." guardian

News International threatens to sue gay website



The gay news website that suggested the footballer Ashley Cole was the alleged subject of a News of the World story has been warned it could face legal action from the paper.

Lawyers acting for the News of the World sent PinkNews.co.uk a letter today in which they said the paper and its stablemate the Sun were reserving their rights to issue proceedings against the website under the Civil Liability (Contribution) Act 1978.

That could involve the website in the libel action brought by Arsenal and England star Cole against the papers.

Cole has taken action over a series of stories in the two papers between February 12 and 19 claiming two unnamed Premiership footballers had taken part in "perverted" and "debauched romps" with a "well known DJ".

He sued the two papers for defamation after internet sites and chat rooms named him as one of the footballers in the story.

PinkNews.co.uk discussed the News of the World story and internet rumours speculating on the identity of the individuals concerned.

It reproduced a pixelated version of a photograph used by the News of the World that claimed to be of a Premiership footballer and a well-known music industry figure, comparing it with a photograph showing Cole and Ian Thompson, better known as the Choice FM DJ Masterstepz, at a party.

Thompson has since joined Cole in taking legal action against the Sun and the News of the World.

The case is highly unusual because neither man has been named by the papers. But their lawyers claim the way the papers wrote their stories led to their identification.

The website said it had not claimed either of the men was gay or had been involved in a taped "romp".

Its article was designed to "explore the media hysteria relating to these allegations and the impact that the internet has had in rumour-spreading".

The website's editor, Benjamin Cohen, said it had behaved in a responsible way in its handling of the story.

"At no point did we claim that Mr Cole was gay," he said. "All that PinkNews.co.uk did was to publish what it believed to be the original version of a photograph edited by the News of the World.

"News Group have merely informed us of their rights to bring proceedings. As yet, proceedings have not been issued."

PinkNews.co.uk has appointed solicitors at Stock Fraser Cukier to represent it. guardian
