The first formal court proceedings are being launched against music fans accused of illegally distributing music on the internet, it has been announced.

The British Phonographic Industry (BPI), the UK's record industry's trade association, said it was lodging civil action against people who had refused to settle.

The lawsuits are being taken against five individuals who, between them, are accused of making 8,906 songs available to millions of people around the globe.

The BPI is claiming compensation and costs against three men and two women on behalf of record companies whose music has allegedly been uploaded on to peer-to-peer networks without permission.

The move against the five, from King's Lynn, Norfolk; Crawley, West Sussex; Port Talbot and South Glamorgan in south Wales and Brighton in East Sussex, follows out-of-court settlements of up to £6,500 with 60 UK internet users.

BPI chairman Peter Jamieson said: "Music fans are increasingly tuning into legal download sites for the choice, value and convenience they offer.

"But we cannot let illegal filesharers off the hook. They are undermining the legal services, they are damaging music and they are breaking the law."

BPI General Counsel Geoff Taylor said: "We have tried to agree fair settlements, but if people refuse to deal with the evidence against them, then the law must take its course. That's why we have had no choice but to take these five individuals to the High Court.

"We will be seeking an injunction and full damages for the losses they have caused, in addition to the considerable legal costs we are incurring as a result of their illegal activity."

The BPI says illegal filesharing was a key factor in the recording industry's 22% worldwide sales downturn between 1999 and 2004.

sorry, but what total utter b*llocks by the BPI. I think they should be sued for being responsible for churning out some dire music over the last decade or so - they ought to look closer to home for the reasons for downturn in sales.

CD prices used to be a total rip-off until the likes of Play and CD-Wow came along. Not only that a lot of 'consumers' (music lovers) are ripped off by record companies that fill many albums with only half a dozen half-decent tracks. The artist hardly makes any money from record sales - they rely on merchandising, a complete rip-off industry in itself. So, all in all, the BPI's action is a bit rich.

Bottom line is this: have you ever seen any poverty-stricken decent artist?

This makes me sick. I heard on the news the other day that they were trying to get a law passed so they can trace through the internet terrorist activities and the people who make those sick sites promoting terrorism. You know the kind of thing that KILLS PEOPLE.
And what about online paedophiles? Jesus they care more about money than lives. Funny how they are allowed to trace people for downloading music before trying to catch the worst kinds of criminals.
Anyone seen 'Cribs' on MTV? Those poor feckers with their mansions might only be able to have 5 cars instead of 6 now. :roll:

I would never suggest that its fine to download any copyright material, not least those that even sell stuff for money.

However, the music, movie, tv industry is utterly ignoring what the consumers want.

consider this...

1. Consumers in the UK want to watch 'lost'
2. it was aired in the USA spring 2005 (i think)
3. consumers want it NOW
4. tv company says to uk people, no, you can wait.

5. technology allows easy file transfer of all 'lost' immediately without cost.

6. consumer is faced with either waiting for the first UK tv showing, or...to download it. Understandably, some will not wait

There are some who already recognises that things should be released on ALL formats when first aired. So, if a tv show is aired on usa tv, it should be available to buy immediately on DVD anywhere.

But no, they won't do that, not for a decade or so yet. Instead, they'll threaten, sue, and instill fear in the very consumers who fund their mansions.

In an era where technology will soon allow the transfer of a 4.5 gig DVD over the net in less than an hour, the industry still refuses to accept the fact that if a consumer wants something....they will get it..one way or another.

They are supposed to be suing them for around £3,600 each. 5????, i read they got something like 60 or something. Anyway, £3,500 each, they'll be getting money for nothing it seems then. But of course, they'll just come out with, we are losing revenue so...

file sharing benefits bands. Went to see a band tonight (Arctic Monkeys - see music thread) who have released just double sided single, and the venue was rammed to the rafters with people singing along with every word of every song. That is as a direct result of file sharing as there is no other way of getting hold of their tunes.

Oh..am with you now!!!Yes..Absolutely!
My daughter went to a battle of the bands night the other night andbrought a CD home.It was excellent.We;ve already shared it with peeps...this band had no record deal yet the consumer can enjoy the music..Its time the music moguls realised times have changed,,,,,theres a way forward with individual bands selling direct to the public..
And they need to embrace it NOT fight it..or else all credibilty has gone from the music industry

Don't use file sharing ! It gives away your IP address and makes you tracable !

Use newsgroups many times faster. Torrent you'll be lucky to get much above 10K/s using Newsleecher I get 240K/s. I mainly download things like BBAU and BBUSA. Normal highlights show takes 10 minutes.

And tracing other people ,well it was proven at least 5 years ago that you can embed code inside picture files. And this could be used by Microsoft with a little update to spill the beans on anybody downloading images from say police sting sits. You know the sort I mean. They may even have gone down these lines ,but then there is the risk that some others might exploit this technology.

I agree that generally CD prices are too expensive ,I use PLAY as even new albums are from 8.99. Shame they stopped the likes of Play selling US CDs.

And as things stand with a 2Meg connection a DVD5 (4.7Gb) takes I think 3-4 hours. And if you go for films most are poor quality so your better off waiting 2-3 monthes and buying them from PLAYUSA.

Most tv programs can be found in the Newsgroups mainly AVI files encoded in Divx or XVid.

Now why can't the tv companies rather than winge set-up their own download sites. If the price is right people will pay for their favourite programs. I've said this on another forum about Endimol and the sites and Ebay selling BB footage. There is a demand although limited for people who want to download shows from around the world. I know of one site that sells the footage in VCD and DVD format for a number of BB shows plus other reality TV from around the world.

As a lot of people can't make their own DVDs from the footage they download they would still buy the story / series they liked most on another format so they'd gain both ways.

The market for selling TV program downloads exists ,same with the music. They should take advanage rather than waste money going after the downloaders.
