Scottish Law:

There is no upper age limit in the Act, although agencies can impose one in their criteria for assessing prospective adopters.
There is a lower age limit: people under 21 years of age cannot adopt (except that a birth parent who is 18 or over can adopt his or her child with the married step-parent, although the step-parent can now adopt on his or her own).
Adopters must either be domiciled in Scotland (i.e. consider Scotland to be their long-term permanent home, even if they do not currently live in Scotland) or have been habitually resident in Scotland for more than one year before applying to the court.
Adopters must be either a married couple or a single person. An unmarried couple, whether heterosexual or homosexual, cannot adopt together; only one of them may adopt, as a single person.
In step-parent adoptions, the step-parent can adopt if he or she is married to the birth parent who cares for the child and who consents to the adoption.
In agency adoptions, adopters must have been assessed and approved by an adoption agency. A full assessment report about the applicants is prepared, with references, background information and details of discussions, training and preparation. All the report except confidential third party information is shared with them. The assessment is then discussed at the agency’s Adoption Panel and the applicants are invited to attend. The Panel recommends approval or not, and then the agency decision-maker decides whether to approve or not. Once applicants are approved, any agency can consider placing a child with them.

What adoption agencies are looking for

Most agencies will consider applications from people who are no more than about 40 to 45 years older than the child they wish to adopt. If you are a couple they will make this calculation based upon the eldest partner. If there is a significant age difference between yourself and your partner the agency might take this into account.

The world's gone mad, wasn't there a rule about overweight people also being excluded?

And what about all those nutty actresses adopting kids coz it's the 'in' thing?

If you have the money, you can bypass ANY rules

I didn't know what the age limit was, but I had a feeling it might be in the late 30s for some reason because I knew of a couple whom was trying to adopt after unsuccessfully having a child of their own, they were 36 yrs when they first applied and 40 yrs when they were turned down and they were very fit and healthy. I felt sorry for them because they were on the books for years and they would have taken any child even if was handicapped or of a different race. I think if there is an age limit it should be late 40's but not late 30's. Thats why I asked the question on what the age limit was.

Because of the difficulties of trying to adopt a child in this country many are trying to adopt children whom come from poor countries that have no relatives or have been left such as the little baby girls in India whom get left because the family didn't want a girl due to the fact is cheaper to have a boy as they don't have to provide for a dowry when they marry.
