The 10 point one only applies when 3 people or more are up, e.g. if you guess Bob - 44%, Teresa - 43% and Ghandi 13% and Teresa goes with 43%, then since you've gone for Bob as your first choice to be evicted you don't get full points, but still get 10 for being technically correct. Since the main aim is to predict what percent the person leaving gets, I think that's reasonably fair, especially as it's an unlikely scenario that probably won't occur.
