Canoeist's wife remanded after court appearance

The wife of the former prison officer who allegedly faked his death in a canoe accident was today remanded in custody after appearing in court charged with two deception offences.

Anne Darwin, 57, was accused at Hartlepool magistrates court of dishonestly obtaining £25,000 and £137,000 in 2003. The first figure relates to a life insurance payout while the second covers a policy to settle her mortgage in the event of her husband's death. She was remanded until Friday when she will appear before the same court via video link.

Article continues
During the four-minute hearing, she spoke only to confirm her name.

Mrs Darwin, who moved to Panama seven weeks before her husband reappeared 10 days ago, was arrested at Manchester airport after arriving back in Britain on Sunday morning.

Her husband, John, 57, appeared in the same court yesterday charged with making an untrue statement to procure a passport and obtaining £25,000 by deception in relation to a life insurance policy. His case was also adjourned until Friday.

Mrs Darwin, wearing a cream-coloured woollen jumper, was accompanied by one female security guard during the court appearance.

Magistrates heard that she was accused of obtaining a money transfer by deception of £25,000 on May 16 2003 by claiming that her husband had been killed in an accident.

She is also accused of obtaining £137,000 by deception on May 29 2003 with similar claims.

The tanned mother-of-two sat impassively as the prosecutor, Philip Morley, opposed bail on the grounds that she might abscond.

"The crown do oppose bail because if granted bail, Mrs Darwin may fail to surrender. We say this because she does not have a fixed address in the UK and she has strong links to Panama and she has money in offshore bank accounts, if she was minded to leave the UK," he said.

Mr Darwin, a former teacher and prison officer, disappeared from his home in Seaton Carew, Hartlepool, in March 2002, and was presumed drowned after his wrecked canoe was found. He walked into a central London police station 10 days ago, saying he was a missing man.

Mr Darwin yesterday told his solicitor, John Nixon, he was worried about his wife and was missing her.

"He is desperate to see his wife, to be reunited with her. He is anxious to know about her wellbeing. It is their wedding anniversary in 10 days. They are going to spend their wedding day apart. He is anxious for everything to be resolved. He is in good shape, bearing up," Nixon said.

His wife, who sold the family's two homes, initially claimed she was in "total shock" that her husband was still alive, but later admitted to journalists she was aware he was not dead and that he had been living next door to the family home for much of his disappearance.

Detectives in Hartlepool described Mrs Darwin as very cooperative with "a surreal investigation".

Police yesterday released a fake passport photograph allegedly used by Mr Darwin. The picture - taken from a bogus travel document he had allegedly used in the name of John Jones - shows a man with long hair, balding on top and sporting a lengthy, greying beard.

The inquiry, at one stage lightheartedly dubbed Operation Lazarus, is the biggest undertaken by the Cleveland force in geographical terms.

Det Supt Tony Hutchinson appealed for more information about where the Darwins had been in Europe and North and South America. "We need to know what they have been saying and who to," he said.

Police reopened their brief investigation into the 2002 "drowning" three months ago, because of what Hutchinson called "financial transactions".

Hutchinson said detectives had interviewed the couple's two sons, Mark, 32, and Anthony, 29, who have declared themselves aghast at the news of their father's deception, which Mrs Darwin claimed had always been hidden from them.

Hutchinson said: "There is nothing whatsoever to suggest that they are anything other than victims of this case. If that is the case, they have been duped in what can only be described as a really disgraceful fashion."

John Darwin 'stole dead baby's ID'

Canoe man John Darwin stole the identity of a dead month-old boy to get a false passport, it was claimed yesterday.

The tot's family was appalled by the claim. His sister said: "This is terrible. How low can you get? It makes me shake to think of it."

Darwin, 57, is believed to have scoured graveyards and records in local papers searching for a name he could use after he vanished in an apparent kayak tragedy in 2002.

Eventually, police believe, he chanced on John Jones - a baby born five months before him, but who died a month later.

Like the plot of the hit novel and movie The Day of the Jackal, Darwin is believed to have used John's name to acquire a birth certificate.

He then allegedly used the document alongside a black and white photo of himself sporting a long bushy beard to get a passport.

It is claimed the fake ID was used on trips to Gibraltar and Spain to view a sailing boat in 2005, and last year to travel to Panama City and Costa Rica with his wife Anne, 55.

Darwin, formerly of Seaton Carew, Hartlepool, is accused of making an untrue statement to procure a passport and dishonestly obtaining £25,000.

John Jones was born on March 27, 1950, at his gran's home in Sunderland. He died five weeks later from enteritis at the city's Hospital for Infectious Diseases.

His sister Frieda Woods, 55, who lives close to the cemetery where her brother is buried, said: "It's terrible to think that this man may have used my brother's name in his scheme. I feel terrible, it's such a shock. When I heard Darwin was using the name John Jones, I did think 'That's my brother's name'.

"But I never thought Darwin could have stolen it from him.

"My parents always used to speak about John and told us he'd died barely a month after being born.

"He was premature and underweight. In those days they couldn't do as much for babies like that.

"My parents are now dead, but they never forgot him. John was their first born, the eldest of nine."

Frieda's youngest brother Alfred Jones, 50, has been warned by police his brother's name may have been used by Darwin.

He said: "If that's what he did he's brought an innocent family into this, and we're disgusted.

"I felt sick to the stomach at the thought of my brother's name being used in this way. It's despicable."

John was the son of river worker Alfred John Jones and his wife Lily.

Buried on May 3, 1950, his body now lies in Ward 2, Section A, grave No3273A in Sunderland's main cemetery. The spot is marked by a plain white plaque and a mass of leaves .

Grave digger David Sandy, 54, who went through the city's Grave Register dating from 1858 to trace John's last resting place, said: "It's on common ground.

"In those days they rarely buried children in a whole plot because of the cost. Instead, they used a space for one adult to bury four children, the plots marked a, b, c and d."

Darwin's suspected ploy could have been taken from the pages of Frederick Forsyth's classic The Day of the Jackal.

The best-selling novel, later turned into a movie starring Edward Fox, turns on a plot to assassinate General de Gaulle.

In the build up, Fox trawls graveyards looking for the headstone of a baby boy whose name will be the basis of a false identity.

Going to the Central Registry of Births, Marriages and Deaths, he buys a copy of the baby's birth certificate.

It is the proof he needs to apply successfully for a passport.

Cleveland Police confirmed they were looking at the use of baby John Jones's name in their inquiry.

Information flooded in from around the world yesterday following the release of a photo of Darwin showing him bearded.

Canoe sons refuse to help police

The sons of canoeist John Darwin are questioning lawyers before they help police with their investigation.

Cleveland Police stressed that Mark, 32, and Anthony Darwin, 29, were still being treated as victims even though they had sought advice from solicitors.

Reports suggested that the move - only days after their parents were charged with fraud - was hampering the probe by detectives.

However, a police source played down the move.

They said: 'Quite simply as far as we are concerned they are still witnesses, victims and from our point of view nothing has changed.

'They are entitled to seek legal advice before they speak to police and this is not slowing the police inquiry down one jot.

'Mark and Anthony are victims and they are not going to be able to help us in relation to the offences, but they are giving us useful background information about the events running up to the disappearance of their father.'

The sons ended contact with their parents last week when it emerged that Mrs Darwin, 55, had known her husband John, 57, was alive.

In a statement, they said they were the victims of a scam and that they wanted nothing further to do with their mother and father.

But the Northern Echo reported that Mark and Anthony have apparently delayed the inquiry by refusing to talk to detectives.

A police source said: 'They are refusing to speak to us now, which is going to slow us right down.'

A Cleveland Police spokeswoman said: 'Anthony and Mark Darwin are entitled to obtain legal advice if they wish to do so.

'A family liaison officer has been appointed and has spoken to them on a number of occasions.

'Unless the situation changes they will continue to be treated as witnesses.'

Christmas behind bars for 'canoe' couple

‘Reggie Perrin’ canoe man John Darwin and his wife both face Christmas behind bars after appearing, separately, in court by video link today.

Darwin, 57, who vanished from the beach at Seaton Carew before reappearing after more than five years, was remanded in custody by Hartlepool magistrates.

His wife, Anne, 55, also appeared via video link from Low Newton Prison for a brief hearing. She spoke only to confirm her name and age and was remanded in custody until January 11.

Darwin, a father-of-two, former teacher and prison officer, is charged with dishonestly obtaining £25,000 and making an untrue statement to procure a passport.

Anne Darwin is accused of dishonestly obtaining a £25,000 life insurance payment and a policy worth £137,000 which settled her mortgage in the event of his death.

A police investigation was launched after Darwin walked into a London police station on December 1 to declare: "I think I'm a missing person."

He disappeared from his home in March 2002 and was presumed drowned after his wrecked canoe was found. The following year a coroner officially declared him dead.

Mrs Darwin initially claimed she was in "total shock" that her husband was still alive.

But it later emerged she had known he was not dead - and that he had been living next door to the family home in Seaton Carew for much of his apparent disappearance.

The couple's sons Mark, 32, and Anthony, 29, released a statement saying they wanted no more contact with their parents.

Canoe man and wife reunited in court

‘Reggie Perrin’ canoeist John Darwin and his wife were reunited today – to jointly face charges of obtaining more than £250,000 by deception.

The couple were brought together for the first time since John Darwin, 57, walked into a London police station and announced: “I think I’m a missing person.”

His back-from-the-dead appearance after going missing while canoeing in 2002, set off a chain of events which eventually led to today’s appearance at Hartlepool Magistrates’ Court.

But despite being just inches apart, the couple didn’t even appear to acknowledge each other.

They face six charges of obtaining money by deception, including £137,515 from Norwich Union Life Services, £25,000 life insurance from Unat Direct Insurance, and more than £58,000 from Capita Hartshead Civil Service Pension Scheme.

The couple have been on remand at separate prisons since Anne Darwin, 55, returned from Panama before Christmas, where she had intended to start a new life.

Mr Darwin also faces a separate charge of making false statements to procure a passport.

Today they both only spoke only to confirm their names and ages during a brief hearing. They were remanded in custody until January 18. No pleas were entered.

Mr Darwin disappeared after taking his canoe into the sea opposite his home in Seaton Carew, Hartlepool, in March 2002. A huge air-sea search failed to find any trace of his body and he was pronounced dead by police and a coroner the following year.

It has since been claimed that the former teacher and prison officer was living next door to his wife at Seaton Carew home for much of the time he was thought to have been dead.

After he reappeared in London, the Daily Mirror uncovered a photograph of Mr and Mrs Darwin together in Panama, Central America, with a property agent which was taken more than three years after he had been assumed dead.
